Do you need a permit to remodel a kitchen or bathroom in Evergreen?
Evergreen is part of the City of San José, so the city's building permit rules apply and permits run through SJPermits. That's true whether you live in an older tract near Capitol Expressway, a hillside home off Silver Creek Valley Road or a townhouse in a planned community.
San José sorts kitchen and bath work into three groups:

What kind of homes are in Evergreen?
Evergreen grew in layers. A 2009 historic context statement prepared for the city records that San José annexed large tracts south and east of downtown, Evergreen among them, between 1965 and 1969. Evergreen Valley College recalls that when it opened in 1975, the area was still rural, with family farms nearby and San Felipe Road a two-lane country road.
Later decades brought planned communities into the foothills. The Silver Creek Valley Country Club project, reviewed by the city in 1988, proposed up to 1,550 single-family detached and attached homes around an 18-hole golf course. The Villages Golf and Country Club, a gated 55+ community in the Evergreen foothills, lists 2,309 condominiums and 227 single-family homes.
So an Evergreen remodel can mean anything from a first-generation tract home to a newer house with a homeowners association. The build year matters, since older homes can hide lead paint, tired plumbing and dated wiring that deserve a look once walls are open. Do you need HOA approval in Silver Creek, The Villages or other planned communities?
Often, yes. If your home is in a common interest development, the CC&Rs and architectural guidelines usually say which changes need approval. Interior kitchen and bath work in a detached house may need little or none, while anything visible from outside, plus work in attached homes and condos, commonly does. Every association is different, so read your documents before ordering materials.
A few habits help:
- Ask the management company for the current architectural application and contractor rules.
- Expect requests for your contractor's license and insurance certificate, and for work hours and gate access.
- Get approval in writing before work starts.
- Remember that HOA approval and the city permit are separate. You need both.

Can an Evergreen remodel use Residential Express?
According to the City of San José, Residential Express is a virtual appointment where a permit can be issued during the online meeting. It costs 1.5 times the regular single-family addition/alteration plan review fee. It is limited to one-story single-family homes with remodels of 750 square feet or less, and the property can't be:
- In a Planned Development zoning district
- In a Geohazard or Seismic Hazard Landslide Zone
- In a Wildland Urban Interface area or certain flood zones
- Subject to open code enforcement cases
Projects needing advanced lateral analysis for hillside conditions go to Standard Plan Review. Many foothill and planned-community homes will land there, so check your parcel's zoning and hazard layers on SJPermits before you book.
How do inspections work in San José?
Your Permit Card lists the required inspections and must stay on site where the inspector can see it. Schedule inspections at SJPermits.org or by calling 408-535-3555. Keep plans and manufacturer instructions handy, and make sure every work area is reachable.
What makes remodeling in Evergreen different?
- Gates and rules. In gated communities, crews and deliveries need gate access arranged ahead of time. A missing name on the guest list can idle a tile delivery longer than the merge onto Highway 101 at rush hour.
- Hillside lots. Sloped driveways and limited street parking make dumpster placement and material staging part of the plan.
- Aging in place. In 55+ communities especially, a tub-to-shower conversion or other aging-in-place bathroom updates are common requests.
- Green hills, briefly. The foothills turn green for a few weeks each spring. Schedule the before-and-after photos accordingly.
